PRICES AND PAYMENTS

As you would expect all our prices are based on UK pounds.

The total cost of your order will be the price of the products you order, the delivery charge -if applicable, and any additional services you choose – such as premium delivery.

You will see the total of the above before you submit in your shopping basket. Once you press confirm, the payment will be processed and deducted accordingly.

When deciding whether to accept your order, we may use certain information about you, including any received from our accredited identity verification partner. For example, we may pass on your details for them to check against certain public and private databases. This will help to protect you and us from fraudulent activities.

If we identify a transaction as being potentially fraudulent we may ask our courier to return the goods to our warehouse, we may cancel your order even though you will have received the Order Confirmation email. A confirmation of this will be sent out promptly.

ORDERS

We will take as much reasonable care, as is possible, to ensure that the details of your order and payment are secure. However, in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data you provide when accessing or ordering from our Website.

PAYMENT METHODS

We accept many different types of payment. These include:-

  • Visa and MasterCard
  • Bank Transfer
  • PayPal

DAMAGE, SHORTAGE OR NON-DELIVERY

Damage or shortage of goods found by the buyer must be notified to the Company. Failure to do so may free the Company from any liability in this respect.

We will not accept any claim in respect of damage in transit, shortage or non-delivery unless written notice is given to the Company and/or the Carrier by the consignee as follows:-

  • For damage in transit – within 3 days of the receipt of the goods.
  • For shortages – within 3 days of the receipt of the goods.
  • For non-delivery – within 10 days of the date of the invoice.

QUOTATIONS

Quotations do not constitute an offer and will not bind the Company until an order has been placed and accepted.

STATUTORY RIGHTS

All orders – whether oral or written – are subject to these terms but nothing in these shall be deemed to affect the statutory rights of the Buyer.

AVAILABILITY

All items on our website are in stock within the company and may not always be available for Next Day delivery (for example, it is a very large item and requires delivery via pallet). If you order an item for Next Day delivery and it is not possible to make it within that time, you will be contacted. You will have the right to cancel at this point if you please.

DELIVERY

Our standard delivery is FREE of charge for UK mainland deliveries over £20, but does have geographical limitations where a surcharge is enforced by our couriers. You will be advised prior to payment at the checkout if this is applicable once you have entered your address details.

For example, delivery surcharges are applied to Channel Islands, Isle of Man, Northern Ireland, Scottish highlands & islands and Isle of Wight.

Delivery of products (in stock items) will normally be made within 1-2 working days from clearance of payment. We will endeavour to deliver goods within the times stated online, but goods are subject to availability and delay of delivery is sometimes outside of our control. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. Delivery time is also subject to change due to weekends and bank holidays (for example, if you order goods on a Friday, expect your delivery to arrive as late as the following Tuesday. Also expect another day of delay due to a Bank Holiday in the UK).

On delivery our couriers will deliver the goods unopened, it is your responsibility to check you have received the correct item, the correct number of items and that there is no damage to the item. If there is you must note this on the delivery and call us immediately.

You agree to check the goods on receipt and inform us of any obvious external cosmetic damage following an examination of the goods. If there is any obvious cosmetic external damage to the goods at the time of delivery then you agree to note these on the delivery paperwork or refuse the delivery.

We cannot be held responsible for delays from delivery services, adverse weather, human error or technological errors as these are out of our control.

CANCELLATION

Once you have placed your order it is not always possible to cancel it as we use automated systems that run during times when the business is closed. Should you wish to cancel your order then you need to call us on 0115 837 7972 and notify us with your intention, there is no guarantee that the order will be cancelled and may still be shipped – so you must be quick. We can be contacted between 9:00am – 6:00pm weekdays and 10.00am – 3:00pm on Saturdays, we are closed Sunday (these times are subject to change, such as, Bank Holidays).

If you do not get a written or verbal confirmation – over the phone – then assume that your cancellation has not been accepted. To ensure your cancellation has been processed you must get a confirmation.

RETURNS

Non Faulty Goods

If you decide to return your goods to us we do reserve the right to charge you for collection. Refunds can only be made by the same method used for purchase, as is standard.

If for any reason you need to return an item within 14 days of receiving delivery, then please fill out our returns form and send directly to returns@autowave.co.uk.

You can only return New and Unused items within 14 days of delivery. If the goods have been opened, used or any seal broken you may lose your right to a refund or exchange unless the goods are faulty.

If you are returning goods because you no longer want them you must return the goods in the same condition as received, you must not use the product and you must not damage the packing. If you use the product or damage the packing your right to a refund may be annulled.

Cost of return will be your responsibility, please use a secure and safe way to return your unwanted items.

An item will not be considered as returned until it is at our premises. It is advised that you send all items tracked and signed in case there is a fault by a third party (for example, the courier).

Please ensure you package the product safely and do not stick anything on the box for the item as this may affect your refund.

Faulty Goods

Not withstanding our Delivery condition above if, after the goods have been fitted, you find a fault, we reserve the right to request the following steps are complied with:-

  • You must provide written notice.
  • If the defect is covered under the manufacturer’s warranty, you will be contacted via email with the details of where to send your item off for repair with relevant references and numbers. In a few circumstances, the manufacturer may require you to deal directly with their repair agents to ensure that the process is carried out as quickly as possible for you.
  • Where the manufacturer deems that there is no fault found or the defect is down to customer misuse, you may be charged a No Fault Found Fee of £35.00.

We hold the right to keep your item(s) until any outstanding charges have been paid and may refuse a refund.

Any information found on the Autowave Limited website is intended for guidance only. The website and the products described in it are subject to change without notice.

Copyright in the website, its design, layout, look, appearance and graphics remain our property. The contents of the website may be downloaded, printed or copied for personal use only. We accept no responsibility or liability for the content of websites which are not under our strict control. It is not permitted to create a link to this website without our prior written consent.

We do not guarantee that the Autowave Limited website will be compatible with all hardware and software which may be used by visitors to the site. We will not be liable for damage to, or viruses that may affect, your computer equipment, software, data or other property as the result of your access to, use of or browsing of this website or your downloading of any materials, data, text or images.

LIABILITY

The following provisions set out the entire financial liability of the Company (including any liability for the acts or omissions of its employees, agents and sub-contractors) to you in respect of:-

  • Any breach of these conditions;
  • Any use made or resale by you of any of the goods, or of any product incorporating any of the goods.
  • Any representation, statement or tortious act or omission including negligence arising under or in connection with the Contract.

All warranties, conditions and other terms implied by statute or common law (conditions implied by section 12 of the Sale of Goods Act 1979) are to the fullest extent permitted by law excluded from the Contract.
Nothing in these conditions excludes or limits the liability of the Company:-

  • For death or personal injury caused by the Company’s negligence.
  • Under section 2(3), Consumer Protection Act 1987.
  • For any matter which it would be illegal for the Company to exclude or attempt to exclude its liability.
  • For fraud or fraudulent misrepresentation.

Subject to the above clauses:-

  • The Company’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the Contract shall be limited to the Contract price.
  • We will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at a the time you make the relevant order. Our liability shall not in any event include loss of profit, loss of revenue, loss of business, wasted expenditure, depletion of goodwill, and loss of privacy or any other claims which arise out of or in connection with the Contract.

GENERAL

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
